Terms and conditions
These terms apply to all purchase contracts for vehicles as well as to consignment sales, unless otherwise agreed in writing in the individual contract.
1. Scope
These terms and conditions apply to all contracts between us and our clients concerning the sale of vehicles as well as brokerage in consignment sales.
Deviating terms of the client apply only insofar as we have expressly agreed to them in writing.
2. Offer and conclusion of contract
The presentation of vehicles on this website does not constitute a binding offer but an invitation to make contact. Prior sale remains reserved.
A purchase contract is concluded only upon signature of a written purchase contract by both parties. Only the details set out in that contract are authoritative for equipment, condition and price.
3. Prices and VAT
All prices are in Swiss francs. Whether a vehicle is sold with deductible VAT or under the margin scheme is stated with the respective vehicle and recorded in the purchase contract.
Costs for transport, customs clearance, registration or special equipment are included only where expressly agreed.
4. Payment and retention of title
Unless otherwise agreed, a deposit falls due on conclusion of the contract; the balance is payable before handover.
The vehicle remains our property until payment in full. We are entitled to have a retention of title entered in the register of the competent debt collection office.
5. Handover
Handover takes place at our premises unless otherwise agreed. Agreed dates are indicative unless expressly designated as binding.
The buyer inspects the vehicle at handover. Obvious defects must be notified in writing without delay.
6. Condition and warranty
These are used vehicles, classic cars and youngtimers. Wear consistent with age and use does not constitute a defect.
We describe the condition of every vehicle to the best of our knowledge. Information on previous owners, mileage and history is based on the documents available to us and on information provided by previous owners.
The scope and duration of any warranty are agreed individually in the purchase contract. In relation to consumers, mandatory statutory provisions apply; a complete exclusion of warranty is not possible in that relationship.
7. Consignment sales
In a consignment sale the vehicle remains the property of the principal until it is sold. We take on preparation, presentation, marketing and sales negotiations.
The minimum sale price, the commission and the duration of the mandate are recorded in writing in a separate consignment agreement.
The principal warrants that they may freely dispose of the vehicle, that it is free of encumbrances and that the information they have provided on condition and history is accurate.
8. Liability
Our liability is governed by statutory provisions. In cases of slight negligence we are liable only for breach of material contractual obligations and limited to the foreseeable damage typical of the contract.
Liability for personal injury as well as in cases of intent and gross negligence remains unlimited in every case.
9. Data protection
The processing of personal data is governed by our privacy policy.
10. Governing law and place of jurisdiction
Swiss law applies exclusively, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
The place of jurisdiction is Zug, unless mandatory statutory provisions prescribe a different venue.
